Martinez pleads guilty to rape and kidnapping

Alberto Quiroz Martinez, 29, changed his plea to guilty Friday morning on charges of kidnapping, rape and sodomy connected to the disappearance of a Hermiston woman in April.
Thomas Gray, Martinezs defense attorney, said during the hearing at Hermiston Circuit Court before Judge Dan Hill that Martinez signed a plea petition changing his plea to guilty for one count each of first-degree kidnapping, first-degree rape and first-degree sodomy.
Hill spelled out the stipulated sentence of 35 years in Oregon Department of Corrections for all three charges, with no chance for early release during the hearing. Sentencing is scheduled for Thursday at 9 a.m. at the Hermiston Circuit Court.
Martinez wanted to postpone the sentencing more than one week so he could speak with family members in person. He said many family members are out of town for the holidays.
I would rather tell them in person than have them read about it, Martinez said via closed-circuit video from the Umatilla County Jail in Pendleton. I want to postpone the sentencing for other people. This is a big thing and it is going to affect a lot of lives, including the victim.
Martinez took the woman from her Hermiston workplace early April 26 to his house on Powerline Road, near Interstate 82 west of the city limits. Prosecutors have said Martinez tied up the then-26-year-old woman and stuffed her in the trunk of his 2006 Subaru Legacy, before driving about 300 miles to her grandparents cabin in northern Klamath County.
On May 1, law enforcement surrounded the cabin and after a two-hour standoff, Martinez exited the cabin with the woman at knifepoint, using her as a human shield. He was shot by an Oregon State Police SWAT team member grazed in the head, according to state police and arrested.
At the time of the incident, prosecutors in Umatilla County said Martinez would also be prosecuted in Klamath County, but Friday morning, Umatilla County District Attorney Dan Primus said the man would not be charged and prosecuted in Klamath County.
Instead we negotiated the case in whole, and we feel that 35 years encompasses all the charges, Primus said.
Martinez, previously an irrigation technician for Threemile Canyon Farms, west of Boardman, was convicted in January 2004 of kidnapping and attempted rape under similar circumstances. As part of a plea agreement, he pleaded guilty to reduced charges stemming from the June 2003 kidnapping of a former girlfriend in Pendleton. He served 7 1/2 years in prison and was on post-prison supervision. He is a registered sex offender.
